Licensing for OMA and Marlin-enabled
services
Introduction
On February 9, 2007, Intertrust announced a licensing
program for OMA and Marlin DRM services. In addition,
major operators and the GSM
Association endorsed the licensing program as a positive
step forward for the industry.
The program has numerous attractive features and is aimed
at delivering a licensing framework that enables the adoption
of OMA and Marlin-enabled services.
- License to Intertrust, Philips and Sony patents for
OMA and/or Marlin DRM services
- Active Subscriber Domain and Total Subscriber options
for operators
- Transition path between Active Subscriber Domain and
Total Subscriber options
- Available to network operators, DRM software vendors
or other service providers
- Coverage for current and future versions of OMA and
Marlin DRM
- Financial incentives for early adopters

Service Licensing Options
[ASDL] Active Subscriber Domain License:
An Active Subscriber
Domain is an individual activated service provider account that includes one
or more devices or individuals tracked via an OMA or Marlin unique subscriber
or domain ID.
Our rate is €0.09 per Active Subscriber Domain per year.
[TSL] Total Subscriber License

TSL Early Adopter Incentives (can be used in combination
with each other in a consistent fashion):
- 50M+ Incentive:
Any licensee who takes (or transitions to) a Total
Subscriber License in the first three years of the
program’s
life will pay the above TSL royalties for their
first 50M subscribers and 0.7 times the above
TSL royalties for all subscribers above 50M.
- 1x TSL
Limiter: Any licensee who takes (or transitions to)
a Total Subscriber License in the first nine months
of the program’s
life will benefit from their total subscriber
royalty base never exceeding the number of total
subscribers they have on the day they sign up
to the program, regardless of the actual number
of total subscribers they might later have in
a given year. This applies only to subscribers
acquired through market expansion activities
other than mergers and acquisitions with other
operators or service providers.
- 1.2x TSL Limiter:
Any licensee who takes (or transitions to) a Total
Subscriber License in the first three years of the
program’s
life will benefit from their total subscriber
royalty base never exceeding 1.2 times the
number of total subscribers they have on
the day they sign up to the program, regardless
of the actual number of total subscribers
they might later have in a given year. This
applies only to subscribers acquired through
market expansion activities other than mergers
and acquisitions with other operators or
service providers.
[ASDL-TSL Transition] Transition from Active Subscriber
Domain to Total Subscribe License
At any time during the first three years after signing
up to an ASDL, an operator can “upgrade” to
a TSL with one year’s notice and a payment of a buy-in
fee equal to 1.2 times the difference in payments from
prior years and the payments that would have been made
had the total subscriber model been adopted from the outset.
These rates apply for current and future versions of Marlin
and OMA DRM.
